General terms and conditions of sale

The present conditions of sale apply to the products of the company L'Atelier de Solène sold on the website www.latelierdesolene.fr operated and put online by the company L'Atelier de Solène.

These conditions of sale apply between the company L'Atelier de Solène and any individual or legal entity wishing to make a purchase on the site www.latelierdesolene.fr. The buyer declares to have full legal capacity.

The conditions applicable to the order of a product by a customer are those in force on the day of the order.

The customer can contact us by using the contact form provided for this purpose either on our site or at the following e-mail address: contact@latelierdesolene.com.

Article 1: Acceptance of the general conditions

The Customer acknowledges having read and expressly accepted the General Terms and Conditions of Sale in force on the date of the Order, prior to placing the Order on the Site. Acceptance of the General Terms and Conditions of Sale is effected by the validation of the Order by the Client. By proceeding to the payment, the client indicates that he or she accepts, without reservation, the present General Terms and Conditions. These conditions are the only applicable conditions and prevail over all other conditions

Article 2: The contract

The contract can be updated or modified at any time.

The applicable conditions are those in force on the Atelier de Solène site at the time of the validation of the order. It is therefore necessary to read them again with each order.

Article 3: The products

The products offered on the site are those described at the time of consultation by the customer. L'Atelier de Solène commits itself to pay attention to the description of its products and to provide the maximum of details about them. L'Atelier de Solène makes sure that the photos reflect reality as faithfully as possible but it is possible that the similarity is not exact in terms of colors, dimensions or other.

A non-substantial difference may therefore be present on the site, which the customer acknowledges and accepts.

L'Atelier de Solène makes every effort to verify the accuracy of the information published on the website, in the catalogs, or in the advertisements. However, the company does not provide any explicit or implicit guarantee concerning the accuracy, reliability and completeness of such information.

The products of Atelier de Solène are sold within the limits of available stocks. In the event of an out-of-stock condition after the validation of the order, the customer will receive an email: the order will be cancelled and the buyer will be refunded. Given the specific nature of the production of its jewelry in limited quantities, L'Atelier de Solène reserves the right to limit the quantity of products that can be ordered by a customer during a single purchase operation.

Article 4: Prices

The prices displayed on the site are in euros, including all taxes (French VAT and other taxes applicable on the day of the order) but excluding participation in shipping costs (order processing, packaging and delivery).

L'Atelier de Solène reserves the right to modify the prices of the products but the price invoiced to the customer will always be the one displayed at the time of the validation of the order, under reserve of availability.

For deliveries abroad, the payment of duties, various taxes and customs clearance are the responsibility of the customer.

Article 5: The customer

The customer must pay attention to the recording of his personal data and to the accuracy of the latter. L'Atelier de Solène is not responsible in case of impossibility to deliver the product due to an error of the customer in the registration of his personal data.

L'Atelier de Solène is not responsible for verifying the identity of the customer.

Article 6: The modalities of order

The customer must imperatively follow the different steps set up on the Atelier de Solène website to validate his order.

From the moment the order is validated, the customer accepts all the stipulations and this takes the value of a contract.

L'Atelier de Solène advises you to check carefully the details of your order before validating it. These details are available in the "My account" section.

L'Atelier de Solène reserves the right to refuse or cancel orders at any time for legitimate reasons. Indeed, L'Atelier de Solène can refuse or cancel your order if a disagreement arises concerning the payment of the order or of a previous order or if L'Atelier de Solène suspects a violation of the general conditions of sale or any attempt at fraud.

Discount codes cannot be combined with each other, nor with gift cards.

Article 7: Delivery

In accordance with the provisions of article L 121-20-3 of the French Consumer Code, the Atelier de Solène products ordered are delivered, insofar as stocks are available, within the deadlines indicated on the site as of the validation of the order.

The customer will be informed of any delay in delivery of which Atelier de Solène is aware.

Your order will be delivered to the address communicated to Atelier de Solène at the time of your purchase.

Deliveries are made by the Colissimo service and are therefore added to the prices of the products invoiced.

If your order exceeds €95 TTC, the delivery costs are offered to you exclusively in Metropolitan France.

Shipments of several products ordered at the same time can be split according to product availability.

From the dispatch of the order, the average delivery times are as follows:

- 24 h to 48 h by Chronopost ;

- 2 to 5 working days by Colissimo for France ;

- 5 to 10 working days by international Colissimo.

Article 8: Delivery problem due to the carrier

We have chosen to ship our orders with the Colissimo service.

However, as with any shipment, there may be a delay in delivery.

L'Atelier de Solène and the carriers being distinct and independent entities, L'Atelier de Solène cannot be held responsible for any delay and error of delivery or loss of package attributable to Colissimo.

In the event of delay of delivery compared to the date that we indicated to you in the mail of shipment, we ask you to announce us this delay by writing to us via the contact form present on the www.latelierdesolene.fr site.

Article 9: Payment

All payments must be made in Euros.

The site www.latelierdesolene.fr offers a secure payment by credit card. After confirmation of the order, the latter will validate it once the payment has been made. The customer guarantees that he has the authorizations possibly necessary to use the method of payment selected during the validation of his order. Purchases are debited to the customer's account at the time the order is processed.

In case of refusal of authorization of payment by credit card by the officially accredited and usual Internet organizations or in case of non-payment or in case of non-payment of all or part of a previous Order, L'Atelier de Solène reserves the right to suspend any Order processing and any delivery.

Article 10: Transfer of risks

The risks associated with the products are transferred to the customer at the time the customer or a third party designated by the customer and other than the carrier takes physical possession of the products.

Article 11: Communication

Any communication to be made with respect to the customer shall be deemed to be properly made if it is made to the e-mail or postal address indicated by the customer at the time of the conclusion of the contract.

Article 12: Return Policy and Refunds 

Conditions of return:

The jewels bought in the store can only be the object of an exchange or a credit note within 14 days. 

On our website, if the customer is not entirely satisfied with the products of L'Atelier de Solène, the customer has a right of withdrawal of 14 days from the day of receipt of his order to return one or several products of the order.

If the Order is not returned within this period, the Order shall be deemed final and no reimbursement shall be made, except in the cases provided for in these General Terms and Conditions of Sale.

Returns must be made in their original and complete condition (jewel(s), packaging, accessories). Thus the damaged, soiled or incomplete products will not be taken back. The jewels must not have been worn under any circumstances.

All returns will be subject to a rigorous control by L'Atelier de Solène to ensure that the returned products comply with quality requirements.

Upon receipt of the package by Atelier de Solène and subject to the present return conditions, we will proceed to exchange or refund the order, excluding delivery charges, by crediting the Customer's bank account or according to the method of payment used by the Customer within 14 days following receipt of the package by the seller.

A single exchange of a ring from Atelier de Solène for another size is possible, within the limits of available stocks. Beyond, delivery charges will be billed.

Jewelry sold out or benefiting from any discount code will also not be exchanged nor refunded. When an order is also the object of a jewel offered thanks to a code, the order will not be refunded if the offered jewel is not returned. Engraved jewlery will also not be exchanged nor refunded. 

Article 13: Warranty and liability

In accordance with article 217-4 of the Consumer Code, L'Atelier de Solène will be liable for any lack of conformity that would exist at the time of delivery of the product and that appears within 1 year from the delivery date.

If the customer uses the products abnormally or not in conformity, the consequences resulting from these uses are excluded from the scope of the contractual guarantees of Atelier de Solène. The defaultt shall be deemed non-existent if, at the time of conclusion of the contract, the customer knew of the lack of conformity or could not reasonably have been unaware of it or if the lack of conformity is attributable to him.

We specify, however, that in this respect, it is necessary to take into account the particular nature of our products and that the Customer is obliged to take care of them, in particular by avoiding any contact of the products with detergents or abrasive products (for example chlorine, alcohol, fragrance, etc.). In addition, normal wear and tear and a certain patina due to repeated wearing of our products can under no circumstances be considered as a lack of conformity within the meaning of this provision. We invite you to read the maintenance and use advice on the site.

It is agreed that the Customer must notify us of any lack of conformity, in writing, within a maximum period of two months from the day on which he noticed the default. Failure to comply with this obligation will result in the loss of the Customer's rights for lack of conformity.

L'Atelier de Solène has only an obligation of means during the use of its site by the Customer within the framework of a consultation or an order and its responsibility cannot be engaged for all inconveniences or damages inherent to the use of the internet network, an external intrusion or any case of force majeure beyond its control.

Guarantee & non-guarantee conditions:

All our jewelry is guaranteed for 1 year against any manufacturing defect. During this period, L'Atelier de Solène undertakes to repair the jewelry (excluding shipping costs). After this period, we offer a repair service at a cost.

Repair times:
• Classic repair (clasp, stones, etc.): 1 to 3 weeks.
• Gold plating: 1 month minimum.

Non-guarantee repair rates:
• Clasp, stones, a broken or damaged part: from 3€ to 5€.
• Gold plating: from 10€ to 15€ (this service is subject to validation by our workshops).

Article 14: Personal data

The Customer is informed and accepts that his personal data may be collected by L'Atelier de Solène, which acts as the data controller under the French law 78-17 of January 6, 1978 relating to Information Technology, Files and Liberties as amended on January 20, 2017 [and as amended by the General Data Protection Regulations 2016/679 dated April 27, 2016, applicable as of May 25, 2018].

Collection and use of personal data

"Personal data" refers to information about you as a physical person that you voluntarily communicate when you purchase on the site, or that L'Atelier de Solène collects during your navigation and that allow us to identify you, directly or not.

Personal data includes nominative data (such as your name, contact information) and electronic identification data available on or from your computer ("cookies" or "IP addresses").

The personal data of customers is collected for the following purposes:

- management of Orders and Customer relations;

- informing Customers about offers and commercial information related to the brand;

- strengthening and improving the communication of the Website and the brand by sending, in particular, newsletters and special offers according to the Customer's preferences noted on the Website;

- improving and personalizing the services offered to Customers; and

- compliance with legal and regulatory obligations.

They are intended for the departments in charge of order processing and online marketing (newsletters).

Duration of storage of personal data

The Customer's personal data will be kept for the duration of the use of the service.

Rights of the persons concerned on the collected data 

In accordance with the regulations applicable to personal data, you have the right to access, rectify, oppose, limit the processing, erase and make your data portable.

Each request must be signed and accompanied by a photocopy of both sides of an identity document bearing the Customer's signature and specifying the surname, first name and reply address of the applicant. 

The response to the request made on the basis of one or more Computer Rights and Freedoms will be sent within one month of receipt of the request.

The Customer may communicate to L'Atelier de Solène specific directives in which he or she defines the manner in which he or she intends to exercise, after his or her death, the Computer Rights and Freedoms in accordance with the French Data Protection Act.

 • Security measures

L'Atelier de Solène undertakes to protect and ensure the security and confidentiality of its Customers' personal data in accordance with the French Data Protection Act, in particular by taking all useful precautions to prevent such data from being distorted, damaged or accessed by unauthorized third parties.

In the event of a violation of personal data, L'Atelier de Solène shall notify the CNIL of the violation in question as soon as possible. If the violation of personal data is likely to create a high risk for the rights and freedoms of a Customer, L'Atelier de Solène informs the person concerned of the violation of personal data as soon as possible.

Use of data in the event of a change of control of the company

The data collected by L'Atelier de Solène could be transferred to third parties in the context of a change of control of the company, an acquisition, a collective procedure or a sale of the company's assets.

Personal data policy relating to minors

Access to the Site is not restricted to adults, as it does not contain content that is prohibited for minors under 18 years of age.

The forms and questionnaires on the Site are not intended to collect information on minors. If information is collected on a minor by the Site, the minor's legal representative will be able to contact the Customer Relations Department of L'Atelier de Solène to rectify, modify or delete this information.

Updating of the personal data policy

L'Atelier de Solène may modify the Personal Data Policy at any time.

If L'Atelier de Solène wishes to use your personal data in a manner different from that stipulated in the Personal Data Policy in force at the time of collection, these modifications will be published in a new version of this Personal Data Policy.

Because of the changes that may occur in the Personal Data Policy, the customer undertakes to regularly visit the "Personal Data" section of the general conditions of sale.

Article 15: Waiver

No waiver by us of any of our rights may be inferred except by express, certain and written expression to that effect.

Article 16: Reservation of ownership

The Products remain the property of L'Atelier de Solène until full payment of the price of the Order. No dispute relating to the delivery itself is possible if the package appears to have been delivered, the carrier's computer system or the signature of the receipt being proof of delivery.

Article 17: Proof and Preservation and archiving of transactions

L'Atelier de Solène recommends to the customer to keep a paper trace or a reliable computer support all data related to his order.

The computerized registers, kept in the computer systems of L'Atelier de Solène under reasonable conditions of security, will be considered as proof of communications, orders and payments between the Parties.

Article 18: Competent Jurisdiction

The present general conditions of sale are in accordance with French law. In the event of a dispute, the French courts within the jurisdiction of the Court of Appeal of Paris shall have sole jurisdiction.

Any Order from a Customer shall entail the Customer's explicit and irrevocable waiver of any action of any nature whatsoever that does not fall within the exclusive jurisdiction of French law.
